This privacy policy (the “Privacy Policy”) describes the collection, use, protection, disclosure, correction and deletion of your personal information by Wounded Healers Institute: Training, Advocacy, Consultation, Coaching and Research, LLC (“WHI” and “we”). Please take a moment to read this policy to learn more about our information practices, including what type of information is gathered, how the information is used and for what purposes, to whom we disclose the information, and how we safeguard your personal information. Your privacy is a priority at WHI. This Privacy Policy applies to the WHI website located at www.woundedhealersinstitute.org, including all subpages and successor pages (the “Site”), as well as the services that we offer (collectively, the “Services”). By using our Site or the Services, you agree to the data collection, use, disclosure and storage practices described in this Privacy Policy.

Our Privacy Policy is fueled by our commitment to the following privacy principles:

  • We strive to provide you with access to and control over the information you give us, and we take the protection of your information very seriously.

WHY WE COLLECT PERSONAL INFORMATION & HOW WE USE IT

We collect your personal information because:

  • It enables WHI to deliver our Services to you;
  • It enables WHI to give you convenient access to the Services;
  • It helps WHI keep you informed of educational materials, announcements, special offers, and events that you might like to hear about.

WHAT PERSONAL INFORMATION DOES WHI COLLECT?

We do not collect any personal information from people who only visit the Site. If you sign-up for the Services, we may collect your name, e-mail address, telephone number, date of birth, address, geographic location, health information, username, and password. Your email address may also be collected when you send us an e-mail. Due to the nature of our Services, some of the information we collect from you is of a sensitive nature, including health information.

WHI utilizes online payment systems provided by Square to facilitate payments for the Services. If you choose to make payments using Square, Square will collect certain payment information, including bank account or credit card information. Square’s collection and use of your personal information is governed by the Square Privacy Policy located at https://squareup.com/us/en/legal/general/privacy .

WHAT OTHER INFORMATION DO WE COLLECT?

When you use the Services, some information is also automatically collected through the use of log files, such as your device’s Internet Protocol (IP) address, your device’s operating system, the browser type, the address of a referring web site, and your activity while using the Service.

We may use this information for purposes such as analyzing trends, administering the Service, improving customer service, diagnosing problems with our servers, tracking user movement, and gathering broad demographic information for aggregate use. We may also automatically collect certain information through the use of “cookies.” Cookies are small data files that are stored on a user’s hard drive at the request of a website to enable the site to recognize users who have previously visited them and retain certain information such as customer preferences and history.

If we combine cookies with or link them to any of the personally identifying information, we would treat this information as personal information. If you wish to block, erase, or be warned of cookies, please refer to your browser instructions or help screen to learn about these functions. However, if your browser is set not to accept cookies or if a user rejects a cookie, you may not be able to sign in to your WHI account and may not be able to access certain Service features.

We may also use third parties to provide certain functionalities or to collect, track and analyze non-personally identifiable usage and statistical information from users, such as the user’s browser type, operating system, browsing behavior, and demographic information. These third parties may collect personal information from you in connection with the services they provide and may place cookies, web beacons, or other devices on your device to collect non-personal information which may be used, among other things, to better understand the usage of the Service and the other services tracked by these third parties. We are not responsible for, and do not control, any actions or policies of any third-party service providers. We do not direct the Services to, nor do we knowingly collect any personal information from, children under the age of eighteen (18), without an adult’s consent. If a child under the age of 13 interacts with our Services or otherwise submits personal information to the Site and we learn that that personal information is the information of a child under the age of 13, we will attempt to delete the information as soon as possible.

HOW WE MAY SHARE INFORMATION WE COLLECT

WHI does not and will not sell or rent your personal information to anyone. WHI will disclose your personal information to Mutual Arising Mental Health Counseling, PLLC (“MAMHC”), our affiliate, but only to the extent necessary to deliver the Services. If you sign-up for our Services, you hereby consent to our sharing of your personal information with MAMHC. WHI may disclose your information to third-party service providers for purposes of service delivery, payment processing, or other account-related activities. Such third-party processors are contractually restricted from using or disclosing such information for any other purpose.

We also may disclose personal information when we are required to or we believe it is

appropriate to:

  • comply with the law (e.g., a lawful subpoena, warrant, or court order);
  • to enforce or apply this Privacy Policy or our other policies or agreements;
  • to initiate, render, bill, and collect for amounts owed to us;
  • to protect our or our users rights, property, or safety;
  • to protect our users from fraudulent, abusive, or unlawful use of our Service or Service; or
  • if we believe that an emergency involving the danger of death or serious physical injury to any person requires disclosure of communications or justifies disclosure of personal information. In addition, information about our users, including personal information, may be disclosed aspart of any merger, acquisition, debt financing, sale of assets, as well as in the event of an insolvency, bankruptcy, or receivership in which personally identifiable information could be transferred to third parties as one of the business assets of the company.

 

Our Services use Google Forms to help us obtain personal information, including health information. Our agreement with Google and the methods by which we have configured Google Forms for our Services ensures that Google Forms is compliant with the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”). We may also disclose Aggregated Information to third parties, as described below. Our Services use Google Analytics to help analyze how users use the Services, such as demographics and interest reporting, which enables us to learn more about the characteristics and interests of the users who visit our Site. The tool Google Analytics uses “cookies,” which are text files placed on a mobile device, to collect standard Internet log information and visitor behavior information in an anonymous form. The information generated by the cookie about your use of the Services (including IP address) is transmitted to Google. This information is then used to evaluate visitors’ use of the Services and to compile statistical reports. We will never (and will not allow any third party to) use the statistical analytics tool to track or to collect any personal information of users of our Services. Google states that it will not associate your IP address with any other data held by Google. We will not, and Google states that it will not seek to link an IP address with the identity of a computer or device user. We will not associate any data gathered from the Site or our Services with any Personally Identifiable Information from any source unless you explicitly submit that information via a fill-in form on our website. You can opt-out of Google Analytics without affecting how you visit our site. AGGREGATED INFORMATION

We may create aggregated data relating to our users and the Services for research, analytical and informational purposes. Aggregated data is comprised of data derived from Personal Information and obtained by WHI from other sources in aggregated, anonymous form and does not identify any individual (“Aggregated Information”). Subject to applicable laws and regulations, we use Aggregated Information to understand our customers and to develop, improve, and/or market our Services and to compile research studies and reports. We may provide Aggregated Information to third parties.

DATA STORAGE AND RETENTION

Your personal information is stored on servers in the United States.  You understand and agree that WHI may collect, use, disclose, and otherwise process the information you provide as described in this Privacy Policy even if you are from an area outside the United States. Your personal information may be disclosed in response to inquiries or requests from government authorities or to respond to judicial process in the United States. We will retain your personal information for as long as it is needed to provide you with the Services, or to fulfill any legal or contractual obligations we may have. 

If you are a resident of the European Union (EU): Your personal information will be transferred to and processed in the United States, which has data protection laws that are different than those in your country and may not be as protective.

WHAT PRIVACY ISSUES ARISE WITH LINKS TO OTHER SITES?

This Site may contain links to other websites. WHI has no control over and is not responsible for the privacy policies or content of such sites. In addition, our privacy practices may differ from those of these other sites. If you provide personal information at one of those sites, you are subject to the privacy policy of the operator of that site, not the WHI’s Privacy Policy. Please make sure you understand the other site’s privacy policy before providing personal information.

YOUR CALIFORNIA PRIVACY RIGHTS

Under California Civil Code, California residents are entitled to ask us for a notice describing what categories of personal information we share with third parties or corporate affiliates for those third parties’, or corporate affiliates’ direct marketing purposes. That notice will identify the categories of information shared and will include a list of the third parties and affiliates with which it was shared, along with their names and addresses. YOUR RIGHTS AS A VISITOR FROM THE EUROPEAN UNION (EU):

If you are a European Union resident, our legal basis for collecting and using your personal data or information is to do so with your consent; where we need the personal data or information for performance of a contract, or where the collection and use is in our legitimate interests and not overridden by your data protection interests or fundamental rights and freedoms. In some cases, we may also have a legal obligation to collect the personal information in question. If we collected your personal data or information with your consent, you may withdraw your consent at any time. You also have the right to:

  • Access your personal data or information;
  • Delete, or request deletion of, your personal data or information;
  • Object to or restrict processing of your personal information;
  • Request portability of your personal information;
  • Complain to your local data protection authority at any time;
  • Object to automated decision making; and
  • Update your personal data or information.

Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal information conducted in reliance on lawful processing grounds other than consent. If we ask you to provide personal data to us to comply with a legal requirement or enter into a contract, we will inform you of this and let you know whether providing us with your personal data is required and if not, the consequences of not sharing your personal data with us.

POLICY CHANGES

If there are material changes to our Privacy Policy, we will notify you by posting the updated policy on our Site. We reserve the right to modify this Privacy Policy at any time, so please review this page frequently for any changes. Amendments to this Privacy Policy will be effective when posted. You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted, the changes to any amended or revised Privacy Policy by your continued use of our Services or the Site.

INTEGRITY OF YOUR PERSONAL INFORMATION

WHI allows you to keep your personal information accurate, complete, and up to date. If you identify any personal information that is out of date, incorrect, or incomplete, please let us know and we will make the corrections promptly and use every reasonable effort to communicate these changes to other parties who may have inadvertently received incorrect or out-of-date personal information from us.

INQUIRIES, COMPLAINTS, AND DISPUTE RESOLUTION

If you wish to verify, correct, or delete any personal information we have collected, or if you have any questions or concerns, or if you have any complaints, please contact us at support@woundedhealersinstitute.org If there is a dispute between you and WHI regarding your personal information or this policy, you agree to use reasonable efforts to resolve such dispute with WHI informally and to consult and negotiate with WHI in good faith to reach a fair and equitable solution.
