Each use of the Site by you shall constitute and be deemed your unconditional acceptance of these Terms of Use. If you do not agree to these Terms of Use, you should not use this Site.

INTENDED AUDIENCE

When signing up for our newsletter you become an honorary member of Wounded Healers Institute. This grants you access to our training, coaching, consultation, events, and research. We are inviting you to our community and you are agreeing to come in and take the next steps to engage in our variety of services. You can cancel at any time with no repercussions or prejudice.

To the fullest extent permitted by law, you shall defend, indemnify, and hold harmless the Wounded Healer Institute Parties from and against all claims arising from or in any way related to your use of the Site and/or the content on the Site, a violation by you of these Terms of Use, or any other actions connected with your use of the Site and/or the content on the Site, including any liability or expense, losses, damages (actual and consequential), suits, judgments, litigation costs and attorney’s fees. Wounded Healer Institute will provide prompt written notice of any such claims, but failure to provide such notice will not release you from any of your obligations pursuant to this Section except to the extent that you are actually prejudiced by such failure, and will not relieve you from any other liability that you may have to the Wounded Healer Institute Parties other than under this Section.

NO MENTAL HEALTH THERAPY, DIAGNOSES, TREATMENT OR ADVICE AND DISCLAIMER AS TO ACCURACY OF INFORMATION.

The information contained on the Site is for informational purposes only and may or may not reflect the most current developments. Accordingly, information on the Site is not promised or guaranteed to be correct or complete and should not be relied upon as such. As mental health therapy, diagnoses, treatment, and advice must be tailored to the specific circumstances of each individual case, nothing provided on the Site should be used as a substitute for the advice of a competent mental health counselor or therapist. The materials on the Site do not constitute advice and you acknowledge and agree the Wounded Healer Institute shall not be liable to you or any other party for any act or failure to act relating thereto, in addition to the limitation of liability claims contained in this Terms of Use.

TERM AND TERMINATION

These Terms of Use will take effect at the time you begin using the Site. Wounded Healer Institute reserves the right, with or without notice, at any time, and for any reason to deny you access to the Site or to any portion thereof, and to terminate these Terms of Use. These Terms of Use will terminate automatically if you fail to comply with the terms set forth herein. You may terminate these Terms of Use at any time by ceasing to use the Site, but all applicable provisions of these Terms of Use will survive such termination. Upon termination, you must destroy all copies of any portion of the Site in your possession.

USE OF INFORMATION

Wounded Healers Institute reserves the right, and you authorize us, to use and assign all information regarding site uses by you and all information provided by you in any manner consistent with our Privacy Policy.

If you believe your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have otherwise been violated, please provide a notice containing the following information to our copyright agent:

WAIVER

The failure of Wounded Healers Institute to exercise or enforce any right or provision of these Terms of Use shall not operate as a waiver of such right or provision. Any waiver of these Terms of Use by Wounded Healers Institute must be in writing and signed by an authorized representative of Wounded Healers Institute.

RELATIONSHIP OF THE PARTIES

Nothing contained in these Terms of Use or your use of the Site shall be construed to constitute either party as a partner, joint venturer, employee or agent of the other party, nor shall either party hold itself out as such. Neither party has any right or authority to incur, assume or create, in writing or otherwise, any warranty, liability or other obligation of any kind, express or implied, in the name of or on behalf of the other party, it being intended by both parties that each shall remain independent contractors responsible for its own actions.
